It is widely believed that we are living in a ‘compensation claims culture’, where people are readily seeking financial award for incidents they have suffered which, in the past, they may have considered to be their own fault.

Compensation claims are certainly a worthy way of seeking justice should your life be genuinely disadvantages through an avoidable accident due to the negligence of others. For instance, if you are not issued with the correct safety equipment at work, if you slip on a wet floor in a shop and hurt yourself, or if you are a victim of a car accident you deserve compensation.

However, unfortunately, the growing number of personal injury cases is having a knock-on effect on many local councils and organisations, which are becoming afraid to stage public events in case they end up facing accident claims if a visitor trips over or injures themselves in another way.

There is legal support, though, for such organisers as since April 2007 the Compensation Act has been amended to reflect such cases. Courts are now encouraged to consider the implications of finding the organisers of community events liable for such incidents, in case it deters them from putting together a charitable or beneficial form of entertainment for the locality in future.
