Changes To The Personal Injury Claims Process

From April 2010, the accident compensation claims process is set to change in order to speed up cases relating to road traffic accidents.

If you have been involved in a vehicle accident and are making personal injury claims and the claim is valued at less than ten thousand pounds, then from 6 April 2010 your case will be processed via a new streamlined ‘fast track’ system.

The new process will work by your chosen solicitor completing a Claim Notification Form (CNF), which is sent via email to the insurer of the defendant. They will then have 15 days to respond and admit or deny liability.

When the other party admits liability, your solicitor will then obtain a medical report and send it to their insurer along with a suggested settlement fee. Again, the defendant’s insurer has 15 days to accept the proposed sum or make an alternative offer.

If an arrangement cannot be agreed, your solicitor can then apply to a court for the case to be settled within 10 business days.

The government believes this new system will reduce debate over cases, speed up the injury claims process and limit legal fees and admin costs.
